Yes this is illegal, it is tampering with the mail. Not sure how likely you are to get a prosecution out of it but its really bad manners anyway! If it's a shared bill and the person who is responsible for paying it isn't there get in touch with that person and ask if you can open it. If it's a previous resident and you don't know where they are, put NOT AT THIS ADDRESS, RETURN TO SENDER after crossing the persons name and put it back in the post (no need to stamp it)
